PATRIMONIAL RESPONSIBILITY OF THE PUBLIC ADMINISTRATION IN THE EDUCATIONAL FIELD

Abstract

The article studies the patrimonial responsibility in the educational field of non-higher education educational centers in a context where the actions of educational institutions can have a direct impact on the lives of students, parents and teachers/non-teachers. Patrimonial liability guarantees that any damage caused unduly can be compensated, this procedure being a guarantee for citizens. The different assumptions that must be given to impute responsibility to the Administration will be analyzed, taking into account judgments of the Supreme Court, Constitutional Court and other judicial organisms, as well as different proposals for improvement will be presented to avoid these administrative processes that entail a withdrawal of public resources to face these responsibilities through compensation.
