Abstract
This report proposes disciplinary action by the Educational Inspectorate following a complaint from legal guardians of several female students at a public secondary school in Castilla y León against a Physics and Chemistry teacher due to inadequate physical proximity and unnecessary contact while addressing individual questions in class. The timeline documents initial reports in September, a warning issued by school leadership, follow‐up by the school and the Inspectorate, formal complaints filed in early November, and statements and hearing with the teacher. Evidence indicates repeated minor contacts causing discomfort among some students; no proof was found of more serious conduct or malicious intent, although partial persistence occurred after prior warnings. Under the legal framework (LOE/LOMLOE, LO 8/1985, Laws 39/2015 and 40/2015, Law 2/2010 of Castilla y León, Law 7/2005 of Castilla y León, EBEP and RD 33/1986), the conduct is classified as a minor offence for discourtesy towards the public (art. 83 Law 7/2005), proposing a warning (art. 17 RD 33/1986) and professional monitoring with requirements to avoid physical contact and limit communication with affected students to strictly academic matters. Referral to the Prosecutor’s Office is not warranted due to insufficient gravity.
