Abstract
Before the Administration initiates a disciplinary instruction, our legal system establishes a process which guarantees the correct implementación of the disicplinary process, that is the reserved information. This is a process ordained by the competetent departament as a previous process to delimitate the responsabilty of the civil servant. It tries to clarify aspects such as dates, facts and people involved in the posible illicits that have been reported.
As the reserved information, has not been clearly regulated in our legal system, it is of outmost importance to analyse how the courts and the supreme court have been clarifying and delimiting this process in their respective court rulings, so that inspectors and the Educational Administration can guarantee, both, the basic rights of the civil servant and the adecuate intervention in the preliminary process of the reserved information.
